General Rental Conditions

 

1) Mediating agreement
CASAS MALLORCA acts as the mediator of the rental of holiday accomodations between the interested party and the owner of the accomodation. The rental is contracted between the interested party and the owner, CASAS MALLORCA only acting in the name and on behalf of the latter.

2) Rental agreement and form of payment
The rental agreement enters into efect upon the reservation confirmation by CASAS MALLORCA and the receipt of the down payment as stipulated in the reservation confirmation within 1 week thereof. If such payment should not be received in time CASAS MALLORCA is entitled to cancel the reservation and therewith the rental agreement without any right of compensation for the interested party. The remaining amount of the rent has to be paid the latest 4 weeks prior to the starting date of the rental, if not stipulated differently in the reservation confimation.

3) Liabilities
The description of the rental object has been based on the information supplied by the owner and as checked by CASAS MALLORCA. CASAS MALLORCA does not asume, however, any liability for changes in the caracteristics and the equipment/funishing of the object by the owner in the meantime after.

No liability whatsoever will be asumed for the rental object being affected by higher forces, such as war, strikes, cuts in the public supply of water and/or electricity, damages by storms and rain.

The use of the rental objects will be at the own risk of the interested party and it is advise to contract a travel insurance covering third party damages, also.

The interested party is responsable for his belongings including electronic equipments, jewelery and money. Neither the owner nor CASAS MALLORCA asume any responsablity whatsoever in case of loss or theft.

The interested party makes himself responsable for any damages caused by him, his accompaning persons or animals (the latter are only accepted after prior consent by the owner). In case of damage the owner or CASAS MALLORCA has to be notified immediately.

4) Cooperation
The interested party is held to check the inventory at his arrival and notify, if necessary, the owner or CASAS MALLORCA within 24 hours of anything missing or damaged so that it can be replaced. Reclamations made afterwards cannot be claimed.

Since the rental object often is located in rural or rustic “fincas” it is normal that there may be mosquitos, ants and other small animals. The occurrrance of such insects or animals does not constitute a default of the rental object and does not give the right to any deductions in the rent and/or indemnisations.

5) Inventory and furnishing
The interested party has to be aware that the local standards and tastes of the owner may be diferent to the habits at home. In Mallorca the beds may be narrower and/or shorter than used to, the staircases steepter and kitchen and baths not as perfect. If there are any special wishes (e.g. coffee machine), the owner will try to meet them, however with no obligation. The rental objects generally are equipped with bed sheets and covers, towels and kitchen gear which have to remain in the rental object. Beach towels therefore have to be brought by the interested party.

6) Arrival and check-out
As a rule the rental objects can be taken over from 15:00 hours on the day of arrival. The check-out hat to take place till 10:00 hours the day of departure. There is the possibility to arrange different arrival or check-out times upon prior approval with the owner or CASAS MALLORCA:

7) Cancelations and change of dates
The cancelation of the reservation by the interested party will originate a cancelation fee which CASAS MALLORCA charges in the name of the owner. In the of cancelation up to 90 days prior to the arrival date the fee is 20% of the total rent; up to 60 day 30%; up to 30 days 50% and up to one week 80%. Be it less than a week the full rent will be charged.

8) Place of fulfillment
Place of fulfilment is the address of the rental object. For any differences or legal disputes with the owner of the rental object the parties submit to the courts of Palma de Mallorca; be it with CASAS MALLORCA the courts of Barcelona.
